Product Rental Terms & Conditions
1. Introduction
1.1 These Terms & Conditions govern the rental of medical devices and other products
by LifeTec Health & Living Ltd (hereafter referred to as “the Company”) to customers
and/or consumers (hereafter referred to as “the Customer” or “the Consumer”).
1.2 By renting a medical device and other products from the Company, the Customer
agrees to be bound by these Terms & Conditions (hereafter referred to as “the
Agreement”).
1.3 This Agreement constitutes a binding contract between the Company and the
Customer upon the Customer’s acceptance of these Terms & Conditions either
through electronic acceptance on the Company’s eCommerce website, via payment
link, by requesting, receiving and paying for a product or through any other form of
written or verbal acceptance.
2. Parties to the Agreement
2.1 In cases where the user of the product (the Consumer) is different from the person
or entity making the payment (the Customer), all obligations and responsibilities
outlined in this Agreement apply to both the Customer and the Consumer, except
where explicitly stated otherwise.
3. Rental Agreement
3.1 The rental agreement commences on the date the product is dispatched by the
Company and continues in either weekly or monthly cycles unless and until it is
terminated by either the Company or the Customer in accordance with these Terms
& Conditions.
3.2 The Company reserves the right to amend these Terms & Conditions at any time. The
updated version will be available on the Company’s website.
4. Rental Fees and Payment
4.1 The rental fees will be specified at the time of rental and are payable in advance for
the entire rental cycle period.
4.2 Rental fees are charged for each rental cycle or part thereof.
4.3 A delivery and return charge will apply and will be added to your first rental cycle
invoice. Delivery and return charges are advised at the time of rental booking or
enquiry and acceptance of these charges is confirmed with the customer before any
payments are processed.
4.4 Payment must be made electronically via payment links, electronic invoicing or
through the Company’s eCommerce website and the Customer agrees to the
payment method being stored and used for recurring payments at the renewal of
each weekly or monthly billing cycle until the termination of the Agreement.
4.5. The Company agrees to store customer contact and payment information in strict
accordance with relevant Data Protection and Privacy laws a copy of which is
available to view here.
4.5 The Customer agrees to maintain an up-to-date and valid payment method on file
with the Company and further agrees to update the Company immediately should
the currently stored payment method expire, become depleted of funds, or in any
way cease to be capable of providing for the Agreement.
4.6 Late payments may incur additional charges as specified by the Company.
5. Ownership of Products
5.1 All products supplied under the Agreement remain the property of the Company. At
no point and under no circumstance throughout the Agreement will the ownership
of the Product transfer from the Company to the Customer.
6. Delivery and Return
6.1 The Company will deliver, or arrange delivery, of the product to the address
specified by the Customer.
6.2 At the end of the rental period, the Customer must return the medical device to the
Company in the same condition as it was delivered, normal wear and tear excepted.
6.3 The Customer agrees to retain and keep intact all product packaging and, upon
termination of the Agreement, to affix the return label provided and facilitate
courier collection in any way reasonably possible. The Customer agrees that if they
cannot facilitate collection of the Product within five working days of termination of
the Agreement additional rental charges will apply.
7. Use of Medical Devices
7.1 The Customer agrees to use the medical device in accordance with the
manufacturer’s instructions and solely for its intended medical purposes.
7.2 The Customer must not modify or alter the medical device in any way.
7.3 The Customer is responsible for any damage to the medical device during the rental
period, except for normal wear and tear.
8. Maintenance and Repairs
8.1 The Company is responsible for the maintenance and repair of the medical device
due to normal wear and tear.
8.2 If the medical device requires repair due to misuse or negligence by the Customer or
Consumer, the Customer will be responsible for the cost of repair.
9. Termination
9.1 Either party may terminate the rental agreement by notifying the company in writing
such as by email, text or other written manner.
9.2 The Company may terminate the rental agreement immediately if the Customer
breaches any of these Terms & Conditions.
10.Governing Law
10.1 These Terms & Conditions are governed by the laws of the Republic of Ireland.
10.2.Any disputes arising out of or in connection with these Terms & Conditions shall be
subject to the exclusive jurisdiction of the courts of the Republic of Ireland.
11.Customer Information
11.1. The Company will process personal data in accordance with applicable data
protection laws and the Company’s Privacy Policy, available on the Company’s
website.
